Dispute Resolution
Good Faith Negotiation
Disputes arising from the Operator Agreement or related business activities should first be addressed through direct, good faith negotiation for 30 days from written notice.
Mediation
If negotiation does not resolve the dispute, the parties submit the matter to mediation in Sonoma County, California. If mediation does not resolve the dispute, it is settled by binding arbitration under the rules of the American Arbitration Association.
Binding Arbitration
The prevailing party may be entitled to recover reasonable attorney fees and costs. Either party may seek injunctive relief for breaches of confidentiality or non-circumvention provisions.
